Products and Services

Validity

Prices quoted are valid and fixed for thirty (30) days only.

Product quoted is subject to availability. Should any product not be available at the time of your event, the product will be replaced with a product of equal value and quality. Content quoted may vary depending on conditions on the day complying with State Regulations and no partial refunds are given if substitutions or omissions are made.

In line with current legislation, the client has contracted FFA – Fireworks for Africa (Pty) Ltd to deliver a service, not fireworks products, meaning that all fireworks products remain the property of FFA – Fireworks for Africa (Pty) Ltd at all times.

Safety and Public Issues

FFA – Fireworks for Africa (Pty) Ltd staff will determine where it is safe for the public to view the fireworks display.

The customer is responsible for monitoring the behaviour of all patrons at the venue.

Crowd control, security and any safety fencing for the fireworks display (before, during and after) is the responsibility of the customer.

It is the responsibility of the customer to provide adequate protection for all FFA – Fireworks for Africa (Pty) Ltd equipment to prevent unauthorised interference or removal of any equipment during the time that FFA – Fireworks for Africa (Pty) Ltd arrives at and departs from the venue.

Permission to use the land for the fireworks display site must be obtained by the event organiser at least 14-days prior to the fireworks display.

It is the responsibility of the event organiser to advise the surrounding neighbours of the firing time, date and place at least 3 days prior to the event, for an additional fee FFA – Fireworks for Africa (Pty) Ltd can arrange this.

Any product and/or display malfunctions or client dissatisfaction of any products and/or services must be reported on the night or within 24 hours to the Display Manager or FFA – Fireworks for Africa (Pty) Ltd Head Office.

Insurance

FFA – Fireworks for Africa (Pty) Ltd has a Products and Public Liability Insurance policy covering R20 million. For any nominated insurance indemnification, the client must request this fourteen (14) days prior to the fireworks display.

Scripted Event Activations with Musical Soundtracks

Client must complete and submit the FFA – Fireworks for Africa (Pty) Ltd online booking form at least forty (40) days prior to the Event Activation date.

Client must either provide a pre-approved music soundtrack for the event activation OR give final approval to a soundtrack created by FFA – Fireworks for Africa (Pty) Ltd at least 30 days prior to the event activation date.

If the client fails to adhere to this timeframe, then FFA – Fireworks for Africa (Pty) Ltd will complete the soundtrack without client approval and the scripting process and product will be finalised based on the FFA – Fireworks for Africa (Pty) Ltd own created soundtrack.

Payment Schedule and Terms

Deposit:

By submitting the FFA – Fireworks for Africa (Pty) Ltd Online Booking form, a deposit invoice will be generated and sent to you and at this time you agree to forward 50% of the total event activation costs as a non-refundable deposit to secure your Event Activation.

Only once this deposit has been received will your event activation date be entered into the FFA – Fireworks for Africa (Pty) Ltd show diary.

Remaining Balance:

An invoice will be sent for the remaining balance and funds must be cleared into the FFA – Fireworks for Africa (Pty) Ltd account no later than fourteen (14) days prior your event activation date.

If you book a show within four (4) weeks of your event activation date, then full payment is required upon submitting the FFA – Fireworks for Africa (Pty) Ltd Online Booking form.

If the balance payment has not been received by the due date, then FFA – Fireworks for Africa (Pty) Ltd have the right to cancel your display unless an alternative arrangement has been agreed.

Postponement

  • If the event activation cannot proceed due to unsafe weather conditions both parties can agree to delay, postpone or cancel the event activation and applicable fees are l listed below.
  • Postponement requests MUST be submitted in writing to FFA – Fireworks for Africa (Pty) Ltd Management and a new date must be mutually agreeable to both parties.

Cancellations

  • FFA – Fireworks for Africa (Pty) Ltd have the right to cancel a firework display prior to or during the performance due to public invasion of security and safety distances, product malfunctions and unsafe weather conditions without incurring any penalties in payment from the client.
  • If the client wishes to cancel the fireworks display, cancellations must be made in writing with the following payment terms applying:
    a) In the case of a cancellation notified more than fourteen (14) days prior to the event, FFA – Fireworks for Africa (Pty) Ltd will retain the non-refundable deposit.
    b) In the case of cancellation notified less than fourteen (14) days prior to the event, FFA – Fireworks for Africa (Pty) Ltd will retain the non-refundable deposit and invoice for any additional expenses incurred.
    c) In the event of a cancellation notified within 48 hours of the event date, FFA – Fireworks for Africa (Pty) Ltd will retain the full monies of the confirmed event activation agreed price.

If any services are subcontracted out by FFA – Fireworks for Africa (Pty) Ltd to provide the agreed fireworks display and the fireworks display is cancelled the client must pay all costs for these services in full within 7 days of cancellation (i.e. barge hire, security services etc).
